These Terms & Conditions of Sale (“Terms”) apply when you purchase products from TinyTone through our website checkout. By placing an order, you agree to be bound by these Terms.

1. Who we are

TinyTone (“we”, “us”, “our”) sells [briefly describe product(s) – e.g. “audio-related consumer products”] online.

2. Eligibility

By placing an order, you confirm that:

You are at least 18 years old (or the age of majority in your jurisdiction), and

You are authorised to use the payment method you provide.

If you are under 18, you may only purchase with the involvement of a parent or legal guardian.

3. Orders and Contract

When you place an order at checkout, this is an offer to buy the product(s).

We accept your order when we send you an order confirmation email. At that point a contract is formed between you and us.

If we are unable to accept your order (for example, due to out-of-stock items, pricing errors, or suspected fraud), we will notify you and, if payment has been taken, we’ll refund you.

4. Pricing and Payment

All prices shown at checkout are in $AUD and include/exclude taxes as stated (e.g. “include GST” / “include VAT” / “exclude taxes”).

You agree to pay the total amount displayed at checkout, including any applicable taxes, shipping costs, and fees.

We may change prices at any time, but changes won’t affect orders that we’ve already accepted.

Payments are processed by our third-party payment provider. We do not store your full payment card details; these are handled securely by our payment provider.

5. Shipping and Delivery

We will ship your order to the address you provide at checkout. Please make sure your shipping details are accurate and complete.

Estimated delivery times are provided for convenience and are not guaranteed. Actual delivery times may vary due to carrier delays, customs, or other factors outside our control.

Risk of loss and ownership of the products pass to you when the products are delivered to your delivery address (or collected, if applicable).

If a package is returned to us due to an incorrect or incomplete address, or repeated failed delivery attempts, we may charge additional shipping fees to resend it or offer a partial refund excluding shipping.

6. Products and Availability

We try to display product descriptions, images, and colours as accurately as possible. However, minor variations may occur.

Product availability is not guaranteed. We may limit quantities or discontinue products at any time.

7. Returns, Refunds, and Exchanges

Your rights to return, refund, or exchange products are set out in our Return Policy (see below), which forms part of these Terms.

In addition, you may have statutory rights under local consumer protection laws (such as rights relating to faulty or misdescribed goods). Nothing in these Terms limits those rights.

8. Use of Our Website and Content

All content on our website (including text, images, logos, and designs) is owned by TinyTone or our licensors and is protected by intellectual property laws.

You may not copy, modify, distribute, or use our content for commercial purposes without our prior written consent.

9. Limitation of Liability

To the fullest extent permitted by law:

We are not liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, data, or goodwill arising out of or related to your purchase or use of our products.

Our total liability to you for any claim arising out of or related to your purchase will not exceed the total amount you paid for the product(s) in question.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under applicable law.

10. Privacy

Your personal information will be collected and used in accordance with our Privacy Policy. At checkout, we collect information such as your name, contact details, shipping address, and order details to process and deliver your order.

11. Governing Law and Disputes

These Terms and any disputes arising out of or relating to them are governed by the laws of Australia, without regard to conflict of law rules.

If you are a consumer, you may also have protections under the laws of your country of residence. Any disputes will be subject to the non-exclusive jurisdiction of the courts of Australia.

12. Changes to These Terms

We may update these Terms from time to time. The version that applies to your purchase is the one in force at the time you placed your order. We recommend saving or printing a copy for your records.
