Terms & conditions

These Terms & Conditions of Sale apply when you purchase products from TinyTone through our website checkout. By placing an order, you agree to be bound by these Terms.

1. Who we are

TinyTone ("we", "us", "our") sells audio-related consumer products online. Contact us at tinytoneaudio@proton.me.

2. Eligibility

By placing an order, you confirm that you are at least 18 years old, or the age of majority in your jurisdiction, and are authorised to use the payment method provided. A person under 18 may purchase only with a parent or legal guardian's involvement.

3. Orders and contract

Placing an order is an offer to buy the selected product. We accept your order when we send an order confirmation email, at which point a contract is formed.

If we cannot accept an order because of stock, a pricing error, suspected fraud, or another reason, we will notify you and refund any payment already taken.

4. Pricing and payment

Prices are displayed in the currency shown at checkout, currently US dollars (USD). You agree to pay the total displayed before payment, including any applicable taxes, shipping costs, or fees shown there.

We may change prices at any time, but a change will not affect an order already accepted. Payments are processed by Stripe or another third-party payment provider. TinyTone does not store full payment card details.

5. Shipping and delivery

We ship to the address provided at checkout. You are responsible for ensuring those details are accurate and complete.

Delivery estimates are provided for convenience and are not guaranteed. Timing may change because of carrier delays, customs, or factors outside our control. Risk of loss and ownership pass to you when the products are delivered to your address or collected, where applicable.

If a parcel returns because of an incorrect or incomplete address or repeated failed delivery, we may charge the cost of resending it or offer a refund excluding non-refundable shipping costs.

6. Products and availability

We try to display descriptions, images, and colours accurately, but minor variations may occur. Availability is not guaranteed, and we may limit quantities or discontinue products.

7. Returns, refunds, and exchanges

Our Return & Refund Policy forms part of these Terms. You may also have statutory rights under applicable consumer protection laws. Nothing in these Terms limits rights that cannot lawfully be limited.

8. Website and content

Website text, images, logos, and designs are owned by TinyTone or our licensors and protected by intellectual property laws. You may not copy, modify, distribute, or use them commercially without written consent.

9. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, consequential, or punitive damages, including loss of profits, data, or goodwill arising from a purchase or product use. Our total liability for a claim will not exceed the amount paid for the relevant product.

Nothing excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or another liability that cannot legally be excluded.

10. Privacy

We collect and use personal information according to our Privacy Policy. Checkout information such as your name, contact details, shipping address, and order details is used to process and deliver your order.

11. Governing law and disputes

These Terms and related disputes are governed by the laws of Australia, without regard to conflict-of-law rules. Consumers may also have protections under the law of their country of residence. Disputes are subject to the non-exclusive jurisdiction of Australian courts.

12. Changes to these Terms

We may update these Terms. The version in force when you place an order applies to that purchase. We recommend saving or printing a copy for your records.
